Terms of Service

These Terms of Service (hereinafter referred to as "Terms") set forth the terms and conditions for use of the services (hereinafter referred to as "Service") provided on this website by Fast Learning (Sole Proprietor: Hiroshi Horii, Fushimi-ku, Kyoto) (hereinafter referred to as "Operator"). Registered users (hereinafter referred to as "Users") shall use the Service in accordance with these Terms.

Article 1 (Application)

  1. These Terms shall apply to all relationships between Users and the Operator concerning the use of the Service.
  2. The Operator may establish various rules and regulations regarding the use of the Service in addition to these Terms (hereinafter referred to as "Individual Provisions"). These Individual Provisions shall constitute a part of these Terms regardless of their names.
  3. In case of any conflict between these Terms and the Individual Provisions referred to in the preceding paragraph, the Individual Provisions shall prevail unless otherwise specified in the Individual Provisions.

Article 2 (User Registration)

  1. Registration for the Service is completed when the applicant agrees to these Terms, applies for registration through the method prescribed by the Operator, and the Operator approves such application.
  2. The Operator may not approve the registration application if the Operator determines that the applicant has any of the following reasons, and the Operator shall have no obligation to disclose the reasons.
    1. If false information is provided in the registration application
    2. If the application is from a person who has previously violated these Terms
    3. If the Operator otherwise deems the registration inappropriate

Article 3 (Management of User ID and Password)

  1. Users shall appropriately manage their User ID and password for the Service at their own responsibility.
  2. Under no circumstances may Users transfer or lend their User ID and password to a third party, or share them with a third party. If the combination of User ID and password matches the registered information, the Operator shall regard such login as use by the User who registered that User ID.
  3. The Operator shall not be liable for any damage caused by the use of User ID and password by a third party, unless there is intentional or gross negligence on the part of the Operator.

Article 4 (Usage Fees and Payment Methods)

  1. The Service is currently provided free of charge.
  2. The Operator may make some parts of the Service paid in the future. In such case, the details, usage fees, and payment methods for paid services shall be separately determined by the Operator and displayed on this website.
  3. When using paid services, Users shall pay the usage fees by the method specified by the Operator.
  4. If Users are late in paying usage fees, they shall pay late payment damages as determined by the Operator.

Article 5 (Prohibited Acts)

Users shall not engage in the following acts when using the Service.

  1. Acts that violate laws or public order and morals
  2. Acts related to criminal activities
  3. Acts that infringe on the copyrights, trademark rights, or other intellectual property rights of the Operator or third parties
  4. Acts that destroy or interfere with the server or network functions of the Operator, other Users, or other third parties
  5. Acts of conducting business using the Service without the prior consent of the Operator (including provision of educational services using group features and content distribution business, whether paid or free)
  6. Acts that may interfere with the operation of the Operator's services
  7. Acts of unauthorized access or attempts thereof
  8. Acts of collecting or accumulating personal information of other Users
  9. Acts of using the Service for fraudulent purposes
  10. Acts of conducting research or gathering information for the purpose of developing or improving competing services
  11. Acts that cause disadvantage, damage, or discomfort to other Users of the Service or other third parties
  12. Acts of impersonating other Users
  13. Acts of advertising, promotion, solicitation, or sales activities on the Service not authorized by the Operator
  14. Acts aimed at meeting strangers of the opposite sex
  15. Acts of directly or indirectly providing benefits to antisocial forces in relation to the Operator's services
  16. Acts of sharing content for which third parties hold copyrights (including contents of books, teaching materials, reference books, etc.) through group features or viewing request features without permission from the rights holders
  17. Other acts that the Operator deems inappropriate

Article 6 (Use of School Group Features)

  1. When allowing students under 18 years of age to use the school group features of this Service, educational institution administrators must obtain prior consent from the students' guardians.
  2. The school group features allow the following access policies to be selected for teachers' access to students' learning content:
    1. Always Viewable (Default Permission): When the educational institution administrator selects this policy, teachers can view students' learning content at any time.
    2. Request & Approval System: When the educational institution administrator selects this policy, teachers require approval from the students themselves to view their learning content. When approved, access rights are valid for 90 days from the approval date.
  3. When selecting the Request & Approval System, please note the following:
    1. Teachers can send access requests to students.
    2. Students can approve or reject requests at their own discretion.
    3. When approved, access rights are valid for 90 days from the approval date.
    4. When access expires, teachers must send a new request.
  4. The Operator shall implement appropriate access control according to the selected access policy, but educational institution administrators and teachers are responsible for respecting students' privacy and properly managing the information obtained.

Article 6-2 (Posted Content)

  1. Copyright for content posted on the Service by Users (questions, answers, hints, images, etc.) belongs to the User who posted it. However, if third-party works are included, the copyright for such works belongs to the original rights holder.
  2. Users warrant that the content they post does not infringe on the copyrights or other rights of third parties.
  3. The warranty in the preceding paragraph also applies when sharing content through group features or viewing request features. Users shall bear full responsibility for ensuring that shared content does not infringe on the rights of third parties.
  4. The Operator may delete such content without prior notice or suspend the User's account if the Operator receives a report of copyright infringement from a third party.
  5. The Operator shall not be liable for disputes with third parties arising from content posted by Users.

Article 7 (Suspension of Service Provision)

  1. The Operator may suspend or interrupt the provision of all or part of the Service without prior notice to Users if the Operator determines that any of the following reasons exist:
    1. When maintenance, inspection, or updates are performed on the computer systems for the Service
    2. When it becomes difficult to provide the Service due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
    3. When computers or communication lines are stopped due to an accident
    4. When the Operator otherwise determines that it is difficult to provide the Service
  2. The Operator shall not be liable for any disadvantage or damage incurred by Users or third parties due to the suspension or interruption of the Service.

Article 8 (Usage Restrictions and Registration Cancellation)

  1. The Operator may restrict the use of all or part of the Service or cancel registration as a User without prior notice if the User falls under any of the following:
    1. If the User violates any provision of these Terms
    2. If it is discovered that there are false facts in the registered information
    3. If there is default in payment obligations such as fees
    4. If there is no response to contact from the Operator for a certain period
    5. If there has been no use of the Service for a certain period since the last use
    6. If the Operator otherwise deems the use of the Service inappropriate
  2. The Operator shall not be liable for any damage caused to Users by any action taken by the Operator based on this Article.

Article 9 (Withdrawal)

Users may withdraw from the Service through the withdrawal procedure prescribed by the Operator.

Article 10 (Disclaimer of Warranty and Limitation of Liability)

  1. The Operator does not warrant, either expressly or impliedly, that the Service is free from defects in fact or law (including defects related to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors or bugs, rights infringement, etc.).
  2. The Operator shall not be liable for any damage caused to Users arising from the Service. However, this disclaimer shall not apply if the contract between the Operator and the User regarding the Service (including these Terms) constitutes a consumer contract as defined in the Consumer Contract Act.
  3. Even in the case provided in the proviso of the preceding paragraph, the Operator shall not be liable for damages arising from special circumstances (including cases where the Operator or User foresaw or could have foreseen the occurrence of damage) among damages caused to Users by default or tort due to the Operator's negligence (excluding gross negligence). Furthermore, compensation for damages caused to Users by default or tort due to the Operator's negligence (excluding gross negligence) shall be limited to the amount of usage fees received from the User in the month when such damage occurred.
  4. The Operator shall not be liable for any transactions, communications, or disputes between Users and other Users or third parties in relation to the Service.

Article 11 (Changes to Service Content)

The Operator may change the content of the Service or discontinue the provision of the Service without notice to Users, and shall not be liable for any damage caused to Users thereby.

Article 12 (Changes to Terms of Service)

  1. The Operator may change these Terms at its discretion in the following cases:
    1. When the change to these Terms is in accordance with the general interests of Users
    2. When the change to these Terms does not contradict the purpose of the contract and is reasonable in light of the necessity of the change, the appropriateness of the changed content, and other circumstances related to the change
  2. In making changes to these Terms pursuant to the preceding paragraph, the Operator shall post on the Service or notify Users by email in advance of the intention to change these Terms, the content of the changed Terms, and the effective date.
  3. When Users use the Service after the effective date of the changed Terms of Service, Users shall be deemed to have agreed to the changes.

Article 13 (Handling of Personal Information)

The Operator shall appropriately handle personal information obtained through the use of the Service in accordance with the Operator's Privacy Policy.

Article 14 (Notices and Communications)

Notices or communications between Users and the Operator shall be made by methods prescribed by the Operator. Unless the User notifies the Operator of a change according to the method separately prescribed by the Operator, the Operator shall deem the currently registered contact information as valid and send notices or communications to such contact, which shall be deemed to have reached the User at the time of sending.

Article 15 (Prohibition of Transfer of Rights and Obligations)

Users may not transfer their contractual status or rights or obligations under these Terms to a third party or provide them as security without the prior written consent of the Operator.

Article 16 (Governing Law and Jurisdiction)

  1. These Terms shall be governed by and construed in accordance with the laws of Japan.
  2. In the event of any dispute concerning the Service, the court having jurisdiction over the location of the Operator shall have exclusive agreed jurisdiction.
